A Texas 3-day notice to quit (non-compliance) is a formal written notice to a tenant of a violation against a rental agreement, for reasons other than the non-payment of rent. The tenant must remedy the breach within 3 days after receiving notice or vacate the premises during that time to avoid a forcible detainer suit by the landlord. The landlord may serve the tenant personally or any person residing at the premises who is 16 years of age or older or by affixing the notice to the inside of the main entry door. There is also the option to deliver by regular mail, registered mail, or by certified mail by requesting a return receipt.

How to Write

The notice can be completed with the following information entered into the blank fields:

  • The County in Texas where the tenant’s rental unit presides
  • Address of the tenant’s rental unit
  • Description of the violation and give instruction to cure
  • Date notice is signed
  • Landlord’s signature and address
  • Date of delivery including the time of day
  • Method of delivery (check appropriate box)
  • Personal delivering the notice must sign and date
